Cheque and return memo

Keep the original cheque and the bank return memo or other admissible bank record establishing dishonour.

Statutory demand notice

Keep a complete copy of the notice, including its demand and cheque particulars.

Postal and service proof

Keep postal receipts, tracking reports, delivery acknowledgments, returned envelopes and any other relevant service evidence.

Underlying transaction

Depending on the case, collect agreements, invoices, account statements, loan records, ledger entries, acknowledgments, delivery documents or correspondence.

Complainant identity and authority

Prepare identity and entity documents where relevant, along with authorisation, board resolution, power of attorney or other authority documents when required.

Complaint and affidavit

Prepare the complaint, supporting affidavit and document list in the format and manner required by the court and current procedure.

Chronology

Make a date chart of cheque issuance, presentation, bank information, notice dispatch, service, expiry of the payment period and filing.

Practical takeaway

This is a preparation checklist, not a universal court filing list. Local e-filing and registry requirements should be checked before filing.
