When it may apply

The section addresses cases where the accused pleads not guilty to the accusation in a summary trial or summons case, or where a charge is framed in other cases, subject to the statutory text.

Amount and time

The section sets a ceiling linked to 20% of the cheque amount and provides a statutory period for payment, with possible extension as permitted by the provision.

Reasons and discretion

The court must exercise the power judicially. The facts, procedural stage and applicable legal principles should be considered.

Different from final compensation

Interim compensation is distinct from final compensation or fine following conviction and from a deposit ordered under Section 148 during certain appeals.

Practical takeaway

Read the current text of Section 143A and relevant judgments before advising on an application or opposing one.
